Welcome to Hommzy. These Terms of Service (“Terms”) govern your access to and use of the Hommzy website, mobile application, and related services (collectively, the “Platform”).
By using Hommzy, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Platform.
1. ABOUT HOMMZY
Hommzy is an online services marketplace connecting customers (“Customers”) with independent service providers (“Vendors” or “Providers”) who offer household and personal services such as cleaning, cooking, laundry, and event assistance.
Hommzy facilitates bookings, payments, and communication between Customers and Vendors but does not employ, supervise, or control Vendors.
2. USER ACCOUNTS
2.1 Eligibility
You must be at least 18 years old and legally able to enter into contracts in Australia to use the Platform.
2.2 Account Creation
You must register an account with accurate, complete, and current information.
2.3 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
2.4 Account Suspension
Hommzy may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Platform.
3. SERVICES AND BOOKINGS
3.1 Vendor Listings
Vendors may create listings for services on the Platform, including descriptions, hourly rates, optional add-on services, and availability. Vendors are responsible for keeping their availability accurate and up to date.
3.2 Booking and Confirmation
Customers may book services through the Platform for time slots that Vendors have marked as available.
All bookings are automatically confirmed once made, Vendors do not have the option to accept or reject a booking. By setting their availability, Vendors agree to honor all bookings during those slots.
3.3 Payment
Payments are processed securely through Stripe. Hommzy charges a 10% platform commission to both Customers and Vendors on each completed booking. All fees are deducted automatically, and the remaining funds are transferred to Vendors according to the Platform’s payout schedule.
3.4 Cancellations
Cancellations are governed by Hommzy’s Refund & Cancellation Policy, which may vary by service type. Customers and Vendors must adhere to the policy, including any applicable fees for same-day or late cancellations.
4. VENDOR REQUIREMENTS
4.1 Independent Contractors
All Vendors are independent contractors, not employees or agents of Hommzy.
Vendors are solely responsible for determining how their services are performed.
4.2 Legal and Insurance Obligations
Vendors must:
- Comply with all applicable Australian laws and regulations;
- Maintain valid public liability insurance (and any other required cover);
- Provide valid identification, proof of address, right to work in Australia (VEVO check), National Police Check, and any relevant qualifications or licenses;
- Ensure the accuracy of information in their listings.
4.3 Performance Standards
Vendors must perform services with due skill, care, and professionalism.
5. CUSTOMER RESPONSIBILITIES
Customers must:
- Provide accurate booking details and access to the premises where services will be performed;
- Treat Vendors respectfully and ensure a safe working environment;
- Not request or engage in any unlawful or unsafe activity.
6. FEES, PAYMENTS & TAXES
6.1 Platform Fees
Hommzy charges a 10% commission on each completed booking from both Customers and Vendors. The commission is automatically deducted from the total booking amount for Customers and from the Vendor’s payout. Fees cover platform maintenance, secure payments, support, and promotional services.
6.2 Payments
All payments are processed securely via Stripe, a third-party payment processor. Vendors receive payouts for completed bookings (after deduction of Hommzy’s commission) according to the Platform’s payout schedule. Optional add-on services selected by Customers are included in the total booking amount and subject to the same commission.
6.3 Taxes
Vendors are solely responsible for their own tax obligations, including GST where applicable. Hommzy does not withhold, remit, or report taxes on behalf of Vendors. Customers are responsible for any applicable taxes related to their bookings, if required by law.
7. CANCELLATIONS AND REFUNDS
If a booking is cancelled, applicable refunds will be processed according to Hommzy’s Refund and Cancellation Policy.
Hommzy reserves the right to issue partial refunds or credits at its discretion.
8. REVIEWS AND RATINGS
Customers may leave ratings and reviews after a service.
Reviews must be honest, factual, and non-defamatory. Hommzy may remove reviews that breach these standards.
9. INSURANCE AND LIABILITY
9.1 Vendor Insurance
Each Vendor is responsible for maintaining their own insurance coverage, including public liability insurance and any other legally required policies.
Hommzy does not provide or arrange insurance coverage for Vendors or Customers.
9.2 Platform Disclaimer
Hommzy is not liable for:
- Any injury, damage, loss, or theft arising from services performed by Vendors;
- Any disputes between Customers and Vendors;
- Any indirect, consequential, or incidental damages.
Hommzy’s total liability is limited to the amount of platform fees paid by the affected user in the previous three months.
10. DISPUTE RESOLUTION
In the event of a dispute:
- The matter must be reported to Hommzy in writing via the official support channel.
- Hommzy will review the issue, gather information from both parties, and facilitate communication to reach a fair outcome.
- Hommzy’s decision or recommendation will be final regarding the use of the platform and any related transactions made through it.
- Customers and Vendors agree not to engage in direct negotiation or settlement outside the platform for disputes arising from Hommzy bookings.
11. PRIVACY
Your personal information is handled in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs).
12. INTELLECTUAL PROPERTY
All content, design, and materials on the Platform are owned or licensed by Hommzy.
You may not copy, modify, or distribute any part of the Platform without prior written consent.
13. TERMINATION
Hommzy may suspend or terminate your account or access to the Platform if you breach these Terms or misuse the service.
14. MODIFICATIONS
Hommzy may update these Terms from time to time. Updates will be effective upon posting on the Platform. Continued use after such changes constitutes acceptance.
15. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
